TERMS

These Terms govern the relationship between Voglia.it and the users of the voglia.it website (“User(s)”). By accessing the voglia.it website (“Site”) and using the services offered therein, as described in Article 1 below (“Services”), the User declares to have read and accepted the Terms & Disclaimer, the Privacy Policy – Data Protection, the Cookie Policy, and the How to Use voglia.it section.

  1. SERVICES OFFERED BY VOGLIA.IT
    • Voglia.it is a web platform (also known as a Webmixer) that, on the Site, offers a granular and immediate selection of various tools to be used to complete users’ internet information searches and browsing.
    • In particular, Voglia.it allows Users to obtain answers to their web searches carried out on the Site, through links and/or widgets to third-party websites (“Third Parties”).
  2. USE OF THE SITE AND SERVICES BY THE USER
    • The User agrees to use the Services exclusively for lawful purposes and acknowledges that failure to comply with this commitment may subject them to civil and/or criminal liability.
    • The User undertakes not to violate or attempt to violate the security of the Site and Voglia.it. In particular, the User agrees not to carry out the following activities on the Site, on Voglia.it’s IT systems, or on those of Third Parties:
      a) unauthorized access, including the use of another user's login credentials to the website and/or Third Party services;
      b) intentional damage and/or interference (including but not limited to bombing, spreading viruses, worms, or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks, or any other method designed to damage or interfere with the operation of a computer system or website).
    • The User agrees not to violate the intellectual property rights of Voglia.it, pursuant to Article 5 below, and those of Third Parties, by respecting their respective policies.
    • The User acknowledges and declares to be aware that Voglia.it has not reviewed and does not endorse the content of Third Party sites and services. Therefore, the User recognizes that Voglia.it shall not be held responsible for the content of Third Party sites or the operation of Third Party services and undertakes to access and use them responsibly and in compliance with the Law.
  3. DAMAGES AND INDEMNIFICATION
    • In the event of a violation by the User of any rights of Voglia.it, the User undertakes to compensate Voglia.it for any direct or indirect damage that may result from the use of the Services in a manner not compliant with the Terms & Disclaimer, Privacy Policy – Data Protection, Cookie Policy, and How to use voglia.it.
    • In the event of a violation by the User of any rights of Third Parties, the User undertakes to indemnify and hold Voglia.it harmless from any liability, claim, or demand by Third Parties, as well as from any related detrimental consequences, arising from the use of the Services in a manner not compliant with the Terms & Disclaimer, Privacy Policy – Data Protection, Cookie Policy, and How to Use voglia.it.
  4. LIMITATION OF LIABILITY
    • Liability in the Provision of Services
      Voglia.it undertakes to provide the Services in the best possible manner, but does not guarantee and is not responsible for ensuring that: (a) the Services meet the specific needs of the User; (b) the Services are error-free. Voglia.it strives to provide the Services continuously, but cannot be held liable for any malfunctions, suspensions, and/or interruptions in the provision of said Services and/or for any resulting damages of any kind. To the extent permitted by law, by accessing the Site and using the Services, the User hereby waives any right to raise any objection, claim, demand, action, or request against Voglia.it in relation to the use of the Services or any other act or fact connected to the Services.
    • Liability Regarding Third-Party Websites
      As stated in Section 2.4 above, Voglia.it is unrelated to Third Parties and their websites and services, has not reviewed them, and does not endorse their content. Therefore, Voglia.it is not responsible for the content, functionality, or legality of Third-Party websites and services that may be linked through the Services. The connection to any Third-Party website or the use of any Third-Party service, other than the Site and the Services, is entirely at the User’s own risk. The User acknowledges that Third Parties, in providing their services, may collect data or request personal information from the User. Voglia.it is in no way responsible for the collection, use, or disclosure of any information collected by such Third Parties. With regard to the processing of the User’s personal data on the Site, reference is made to the document entitled Privacy Policy – Data Protection. Any commercial contact between the User, Third Parties, or any other subject shall not involve, bind, or concern Voglia.it in any way, nor shall it have any effect on Voglia.it. Consequently, by accessing the Site and using the Services, the User expressly waives any right to raise any objection, claim, demand, action, or request against Voglia.it in this regard.
  5. INTELLECTUAL PROPERTY
    • The Site, the trademark, and the domain name voglia.it are the exclusive property of Voglia.it and are protected under the applicable laws on industrial and intellectual property.
    • The User acknowledges that Voglia.it has no rights and is completely unrelated to the trademarks and/or domain names and/or websites (and their content) indicated on the Site, within the designated buttons in the different sections, which are instead owned by or lawfully available to Third Parties.
    • Without prejudice to the provisions of Article 3 above, by accessing the Site and using the Services, the User undertakes: a) not to infringe in any way Voglia.it’s rights on the intellectual property referred to in Section 5.1; b) not to infringe in any way the rights of Third Parties on the intellectual property referred to in Section 5.2; c) in any case, not to infringe, even if not expressly mentioned in Sections 5.1 and/or 5.2 above, the intellectual property rights of Voglia.it and/or Third Parties.
  6. TERMINATION
    • Voglia.it reserves the right to cease providing Services at any time.
    • The User acknowledges and agrees that Voglia.it shall not be held liable in any way for any cost, expense, or damage resulting from the termination referred to in Section 6.1 above.
  7. APPLICABLE LAW AND JURISDICTION
    • The Terms & Disclaimer are governed and interpreted according to italian language and law.
    • Subject to the provisions of the Consumer Code (Legislative Decree 206/2005 as amended), any dispute arising from the relationship governed between Voglia.it, on one side, and the User(s), on the other, shall be exclusively submitted to the jurisdiction of the Court of Turin (Italy).
